Die starke Mitwirkung des Bundesrates an der Gesetzgebung hat relativ bald zu Klagen über die Politikverflechtung, Reformstaus oder Blockadepolitik geführt. Wie diese Kritik konkret formuliert wurde und wo die Ursachen der Politikverflechtung liegen, soll mit Hilfe von Lehmbruchs Strukturbruchsthese in Kap. 2 geklärt werden. In Folge der Kritik an den Reformblockaden im Bundesstaat wurde Anfang des neuen Jahrtausends eine Kommission (Kommission zur Modernisierung der bundesstaatlichen Ordnung) eingerichtet, in der Vertreter des Bundes, der Länder und beratende Experten aus der Wissenschaft und den kommunalen Spitzenverbänden gemeinsam nach Lösungen für die Probleme der bundesstaatlichen Ordnung suchten. Welche Ziele dabei verfolgt wurden und welche Veränderungen es durch die 2006 in kraft getretene Föderalismusreform dann gab, ist Thema des Kap. 3.
Das zentrale Thema der folgenden Arbeit ist aber die Frage, wie sich die 2006 in Kraft getretene Föderalismusreform I auf den Anteil der zustimmungsbedürftigen Gesetze ausgewirkt hat und ob nun ein Ende der Klagen über einen durch den Bundesrat und die Politikverflechtung verursachten Reformstau zu erwarten ist. Zur Beantwortung dieser Frage werde ich empirisch mit Hilfe bereits durchgeführter Studien und des DIP (Dokumentations- und Informationssystem für Parlamentarische Vorgänge) des Deutschen Bundestages vorgehen, um in Kap. four die veränderten Anteile von zustimmungs-bedürftigen Gesetzen nach dem Inkrafttreten der Reform im September 2006 nachzuvollziehen.
